ℹ️ What is Business PAN?
What is Business PAN Registration?
A Permanent Account Number (PAN) is a 10-digit alphanumeric identifier issued by the Income Tax Department.
A Business/Entity PAN is the tax identity of firms, LLPs, companies, and other registered organisations. Unregistered sole proprietors use their individual PAN as business PAN.
Why is it Needed?
A Business PAN is required for:
- Legally identifying the entity for tax purposes
- Filing income tax returns
- Opening current bank accounts
- Registering for GST, TAN, or other central/state registrations
- Obtaining Udyam, trade licenses, factory licenses, and pollution NOCs
- Availing government schemes, subsidies, and benefits
Without a Business PAN, many registrations and financial activities cannot proceed.
Who Should Apply?
1) Entities that automatically get PAN (no separate application required)
PAN is generated automatically by the Income Tax Department when these entities are incorporated through MCA:
- Private Limited Company
- Public Limited Company
- One Person Company (OPC)
- Limited Liability Partnership (LLP)
You do NOT need to apply separately for PAN.
It comes bundled with the Certificate of Incorporation.
2) Entities that must apply separately (Form 49A)
These business structures must file a separate PAN application, because they are not created through MCA:
- Partnership Firm
- Society
- Trust / NGO
- Association of Persons (AOP) / Body of Individuals (BOI)
- Co-operative Society
- Local Authority / Government Body ((Usually not applicable to MSMEs))
These entities must apply manually via the Protean (NSDL) or UTIITSL portals.
3) Sole Proprietorship
A sole proprietorship does NOT have its own PAN. The proprietor’s personal PAN is used for all business purposes.
Applicability Triggers
Apply for a Business PAN when:
- Forming a partnership firm
- Creating a society, trust, NGO, AOP/BOI
- Applying for GST or TDS/TCS registrations
- Opening a current account in the firm or entity name
- Applying for business loans or credit
- Getting other registrations (EPFO, ESIC, IEC, Trade Licence, Udyam etc.)
